Welcome to poniesinthesmokies.com (the "Site"), operated by T5 Productions LLC dba Ponies in the Smokies ("PITS," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms of Service. If you do not agree, please do not use the Site.

1. Use of the Site

You may use the Site for lawful purposes only. You agree not to:

  • Use the Site in any way that violates applicable law
  • Attempt to gain unauthorized access to the Site, its servers, or any connected systems
  • Scrape, harvest, or collect information about other users or attendees
  • Interfere with or disrupt the operation of the Site
  • Submit false, misleading, or fraudulent information through any form on the Site

We may suspend or terminate access to the Site for any user at any time.

2. Event Registration and Third-Party Platforms

Registration for the event, its lots, packages, and activities is handled by third-party platforms, including Eventbrite and SignUpGenius. When you click a registration link on the Site, you leave the Site and your transaction is governed by that platform's terms and privacy policy.

All ticket prices, fees, refund policies, transfers, and cancellations are subject to the policies published by the applicable registration platform and by PITS at the time of purchase. Unless stated otherwise at checkout, registrations are non-refundable.

Merchandise is sold by third-party retailers. PITS is not the seller and is not responsible for orders, payments, shipping, returns, or product quality.

3. Submissions and Applications

Some parts of the Site allow you to submit applications, including indoor display entries, vendor and sponsor inquiries, and contact requests.

  • Submitting an application does not guarantee acceptance. Display selections, vendor placements, lot assignments, and sponsorships are at our sole discretion.
  • You must have the right to submit any content you upload, including photos.
  • By submitting photos or other content, you grant PITS a non-exclusive, royalty-free, worldwide license to use, reproduce, display, and distribute that content for purposes related to promoting and documenting the event, including on the Site, on social media, and in event materials. You retain ownership of your content.
  • We may remove or decline any submission for any reason.

4. Event Attendance, Conduct, and Risk

Attendance at the event is subject to the event rules and any waivers, releases, or terms presented at registration or at the event itself.

Motorsports and automotive events involve inherent risks. Attendees, participants, and their guests attend at their own risk and are responsible for their own safety, their vehicles, and their property. PITS is not responsible for damage to or theft of vehicles or personal property, or for injuries occurring at the event or at any associated activity, cruise, or venue.

We reserve the right to remove any attendee, vehicle, or vendor from the event for unsafe conduct, rules violations, or behavior that disrupts the event.

5. Schedule and Event Changes

Event dates, schedules, locations, activities, judging classes, awards, sponsors, and vendors are subject to change. We make reasonable efforts to keep the Site current, but we do not guarantee that all information is accurate or up to date at all times.

We are not liable for losses resulting from changes to, postponement of, or cancellation of the event or any portion of it, including for weather, venue issues, or circumstances outside our control.

6. Intellectual Property

The Site and its contents — including the Ponies in the Smokies name and logo, text, graphics, photographs, video, and layout — are owned by PITS or its licensors and are protected by intellectual property law.

You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written permission, except that you may share links to the Site and use materials we expressly provide for promotional purposes.

Third-party trademarks, including Ford and Mustang marks and the logos of sponsors and vendors, are the property of their respective owners. PITS is an independent event and is not affiliated with, endorsed by, or sponsored by Ford Motor Company.

7. Third-Party Links

The Site contains links to third-party websites, including sponsor and vendor sites, registration platforms, merchandise retailers, and social media pages. We do not control and are not responsible for the content, products, services, or practices of those sites. Links are not an endorsement.

8. Disclaimer of Warranties

The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the fullest extent permitted by law, PITS and its organizers, partners, staff, volunteers, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of or related to your use of the Site or your attendance at the event.

Our total liability for any claim relating to the Site will not exceed the amount you paid to PITS, if any, in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless PITS and its organizers, partners, staff, volunteers, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site, your submissions, your conduct at the event, or your violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-law rules. Any dispute arising out of these Terms or the Site will be brought exclusively in the state or federal courts located in the State of Tennessee, and you consent to that jurisdiction.

12. Changes to These Terms

We may update these Terms at any time. The updated version will be posted here with a revised "Last Updated" date. Your continued use of the Site after changes are posted means you accept the updated Terms.
